1. The entities behind this site

This website is operated by HMR Konsultan (Labuan) Ltd. (LL13580), a body corporate registered in Labuan, Malaysia under the Labuan Companies Act 1990 and licensed as a trust company by the Labuan Financial Services Authority under licence number LT0072.

The HMR Konsultan Group comprises HMR Holdings Sdn Bhd, HMR Konsultan (Labuan) Ltd. and HMR Konsultan Sdn Bhd. Each affiliated company within the Group is a separate legal entity.

Statutory fees and regulatory thresholds change. Any figure published on this website is indicative and stated as at the review date shown on the page. Fees quoted to you in writing take precedence over anything published here.

Where we link to third-party websites, including those of regulators, we do not control and are not responsible for their content.

5. Your data

You agree that we may collect, store and use your information in accordance with our privacy policy. Our maximum data retention period is seven years.

6. Scope of our services

Our services consist of those listed and described on this website. Legal, tax and audit advisory are not included — you will need to arrange these separately, and you are advised to seek independent advice before subscribing to our services. Any additional work or request for customised services is subject to an additional fee, agreed and negotiated in advance. This includes alterations to our standard Memorandum and Articles of Association or standard corporate documents, or incorporation using your own documentation.

We reserve the right to decline, without giving a reason, to accept or process any application for our services.

7. Fees, payment and withdrawal

HMR Konsultan retains ownership of your company or other entity until full payment is received.

Once we have accepted an application you may ask us to withdraw it. Given the nature of the services, whether you are entitled to a refund is entirely at our discretion, and in exercising that discretion we will consider how far work has commenced and what has already been paid out to a government body or third party. Where the service includes incorporating a company or registering an entity, once the submission has reached the jurisdiction's registrar it is not possible to stop the registration process.

If the registrar of companies rejects an application or submission, we will assist you by resubmitting it with the appropriate corrections at no extra charge, other than fees payable to the registrar of companies.

We act as your agent when dealing with a registrar of companies or a tax authority. You remain responsible for any fees, charges, fines, penalties, excess charges, duties, taxes or registration fees incurred.

8. Intellectual property

This website and its contents are copyright © HMR Konsultan (Labuan) Ltd. Anyone wishing to print, reproduce or distribute its contents must first seek written consent. The names, logos and images identifying HMR or HMR Konsultan are owned by HMR Konsultan Sdn Bhd and are used under licence.

All correspondence files and records — other than statutory corporate records — and all data held in our server systems remain the sole property of HMR Konsultan.

9. Complaints

If you are not satisfied with the service you have received, please email info@hmrkonsultan.com with Official Complaint as the subject header, or call us on +60 87 453 580 during Labuan office hours.

You will receive an acknowledgement and be notified within 7 business days. Your complaint will be investigated immediately and responded to within 14 business days. A business day means any day our office is ordinarily open — that is, any day other than a weekend or a public holiday in Labuan, Malaysia.

10. Governing law

These terms are governed by and construed in accordance with the laws of Malaysia, and you agree to submit to the exclusive jurisdiction of the courts of Malaysia — save where a document, agreement or company application form associated with our specific terms and conditions provides otherwise.

Specific terms and conditions tailored to a particular service or jurisdiction are set out in the relevant company application form, and take priority over these terms to the extent of any conflict.
