Every Labuan entity is incorporated through a licensed trust company. You cannot file directly with Labuan FSA yourself, which means the trust company you appoint is not an optional extra — it is the counterparty for the entire life of the structure.

That makes the choice more consequential than it first appears. The incorporation fee is a one-off number that is easy to compare. Almost everything that follows is not, and it is where the real cost of a poor decision shows up.
What a trust company actually does
Incorporation is the visible part, and the smallest. The ongoing work is the resident secretary, the registered office, the annual return, the tax filing, and the economic substance position that has to be defensible every single year.

A trust company that treats incorporation as the product and compliance as an afterthought will get you registered quickly and then leave you exposed at exactly the point where it matters.
Questions worth asking before you sign
Ask who will actually handle your file, and whether that person has dealt with your specific licence type before. A trading company, a leasing company and a holding company face materially different substance tests.
- How many entities of my type do you currently administer?
- Who prepares the annual tax computation, and is it included?
- What happens if the Inland Revenue Board of Malaysia ("IRBM") queries my substance position?
- What are your fees in year two and year three, not just year one?
The cheapest incorporation quote is frequently the most expensive structure over three years. The difference is almost always in what the annual fee excludes.
Substance is the real test
Since the 2019 reforms, the economic substance requirements have been the thing that decides whether a Labuan entity keeps its tax treatment. Employee counts and operating expenditure are tested annually, per activity.
A good trust company will tell you before incorporation whether your intended activity can realistically meet its substance test, and will say so plainly if it cannot. That conversation is uncomfortable and it is exactly what you are paying for.
If a provider has not raised substance with you at all, that is the answer to the question you were asking.
